By accessing or using www.apollo-optimised.com or engaging in our coaching services, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use our services. These Terms and Conditions ("Terms") govern your use of the services provided by Neria, Alenka Pirih s.p. ("We," "Our," "Us").

By accessing or using www.apollo-optimised.com or engaging in our coaching services, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use our services.

  1. Eligibility
    You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

  2. Scope of Services
    Apollo Optimised provides one-on-one coaching, including but not limited to wellness guidance, sleep optimization, supplement strategies, lifestyle redesign, and optional wearable device analysis (e.g., Oura Ring). Coaching is educational and supportive in nature and is not a substitute for professional medical advice, diagnosis, or treatment.

Services include:

  • 3-Month Coaching Package

  • VIP Package

  • Weekly or biweekly sessions via video call (as agreed)

  • Email summaries and optional resources (e.g., PDFs, templates)

  • Sleep data analysis (if the client uses a supported device like Oura)

Exclusions:

  • No ongoing chat support between sessions unless explicitly agreed

  • No diagnostic testing or personalized medical protocols

  • No guaranteed results

  • No endorsements of third-party products beyond shared recommendations

Client Obligations:
You agree to:

  • Provide accurate and complete information (e.g., health history, wearable data)

  • Attend sessions on time and prepared

  • Participate actively and respectfully

  • Respond to communications within 48 hours unless otherwise agreed

Failure to meet these obligations may result in cancellation or termination without refund.

  1. Communication Policy
    Communication is primarily via email and scheduled Zoom or video sessions. We aim to respond to emails within 48–72 hours during business days (Monday–Friday, excluding Slovenian holidays). Urgent matters should be clearly flagged.

  2. Session Scheduling, Cancellations & Recordings
    Clients must provide at least 24 hours’ notice to reschedule a session. Missed sessions without notice are forfeited. Sessions may be recorded (audio/video) for internal review and coaching quality purposes. Recordings remain the property of Apollo Optimised and will be stored securely and deleted after review. By participating, you consent to recordings unless otherwise agreed in writing.

  3. Payments and Refunds
    Payments for coaching are made via bank transfer or other specified methods. All fees are non-refundable once the coaching program begins. Pricing details will be provided upon application approval and are subject to change for future offerings.

  4. Right of Withdrawal (EU Law)
    As an EU consumer, you have a 14-day right to withdraw from this agreement without giving any reason, starting from the date of acceptance. To exercise this right, notify us in writing (e.g., via email) before the period expires.

If you request that services begin during this 14-day period, you acknowledge that you may lose this right once delivery has commenced. Refunds, if applicable, will be calculated based on services delivered prior to withdrawal and processed within 14 days.

  1. Intellectual Property
    All content, including but not limited to protocols, templates, blog posts, PDFs, and coaching materials, is the intellectual property of Uroš Eržen or its licensors. You may not reproduce, distribute, modify, or use this content commercially without prior written permission.

  2. Health Disclaimer & Client Responsibility
    All coaching services are for educational purposes and are not intended to diagnose, treat, or cure medical conditions. Clients must consult their healthcare provider before making significant changes to their health routine. You are solely responsible for your decisions and outcomes resulting from coaching.

Client Warranties:
You affirm that you are physically, mentally, and emotionally capable of participating in wellness coaching. You agree to disclose any relevant health conditions and to provide honest information throughout the coaching process.

  1. GDPR & Data Protection
    Apollo Optimised complies with the EU General Data Protection Regulation (GDPR). We collect and store only the data necessary for coaching purposes, such as your name, contact details, and intake responses. Data is retained for up to two years post-coaching unless required longer by law. You may request data deletion, correction, or export at any time.

We use third-party tools (e.g., Calendly, Mailchimp, Oura) under their respective privacy policies. A full Privacy Policy is available at www.apollo-optimised.com/privacy.

  1. Testimonials and Social Proof
    With your written or verbal consent, we may use anonymized testimonials or comments (e.g., "My sleep improved dramatically") for promotional purposes. You may withdraw this consent at any time by emailing us.

  2. Non-Disparagement and Brand Protection
    You agree not to make any false, defamatory, or disparaging public statements about Uroš Eržen, Apollo Optimised, or our services. Honest feedback is welcome and can be shared privately.

  3. Limitation of Liability and Indemnification
    To the fullest extent permitted by law, Apollo Optimised and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services. You agree to indemnify and hold harmless Apollo Optimised and its representatives from any claims or losses resulting from your participation in coaching or breach of these terms.

  4. Changes to Terms
    We reserve the right to modify these Terms at any time. Updates will be posted on the website. Continued use of the website or services after changes constitutes acceptance.

  5. Governing Law and Dispute Resolution
    These Terms are governed by the laws of the Republic of Slovenia. Before pursuing legal remedies, both parties agree to first seek informal resolution via communication. If unresolved, parties may consider non-binding mediation before taking legal action.

  6. Entire Agreement, Severability, and Waiver
    These Terms, along with any signed coaching agreement or confirmation emails, represent the full agreement between us. If any provision is held invalid, the remainder remains enforceable. No waiver of any right or term shall be valid unless in writing and signed by both parties.

  7. Taxes
    All pricing is inclusive of applicable Slovenian VAT or taxes unless otherwise stated. Clients are responsible for any fees imposed by their payment provider.
